An independent United Nations expert urged the Government of Myanmar to take an “active approach” to protect human rights in the country and commit to implementing reforms to ensure lasting peace and reconciliation.
Presenting his report to the UN Human Rights Council in Geneva, Tomas Ojea Quintana said he welcomed positive steps by the Government to adopt policies to protect the rights of its citizens, but warned that there are “serious human rights concerns that remain to be addressed,” regarding legislative policies, prisoner releases, and poverty and development, as well as ethnic groups.
Mr. Ojea Quintana, who is the Special Rapporteur on the situation of human rights in Myanmar, has consistently called for the immediate release of all prisoners of conscience. He told the Council that while he welcomed the four amnesties that have been granted by the new Government, he was disturbed about discrepancies in the numbers of remaining prisoners, and urged that a “comprehensive and thorough investigation be undertaken to clarify records and determine accurate numbers.”
In his remarks, the Special Rapporteur also focused on poverty and security in the country, and emphasized that it is essential to ensure that development and economic growth are not concentrated in a few areas but includes all of society, including ethnic border areas.
In addition, he stated that an increase in privatization initiatives should be accompanied by appropriate measures to protect land owners, the environment, and any other sectors that may be negatively affected by the activities of private enterprises.
Mr. Ojea Quintana also called on the Government to develop a plan to “officially engage with ethnic minority groups in serious dialogue and to resolve long-standing and deep-rooted concerns,” calling it an essential step for national reconciliation and for Myanmar’s long-term political and social stability.
The upcoming by-election on 1 April, Mr. Ojea Quintana underlined, will be “a key test” of how far the Government has progressed in its process of reform, adding that it is essential that they are free, fair, inclusive and transparent.
The Special Rapporteur stated that the international community also has the responsibility to support the people of Myanmar in the reform process, and urged Government authorities to seek the guidance of the Office of the UN High Commissioner for Human Rights (OHCHR) and other international bodies.

Speculation has been building in recent weeks that Ms. Suu Kyi will be rewarded with a senior role in the government – including possibly a ministerial post looking out for health or education – if she wins as expected in Myanmar’s upcoming April 1 parliamentary by-elections. For Ms. Suu Kyi, such a post would have been almost unthinkable as recently as a few months ago – especially after she spent much of the past 20 years under house arrest – and would give her a stronger voice in the government on issues she cares about, including public health.
It would also potentially help Myanmar’s leaders, earning further kudos for President Thein Sein after a year of reforms, including the legalization of Ms. Suu Kyi’s National League for Democracy political party and the release of scores of political prisoners. That, in turn, could help accelerate Western governments’ moves towards easing economic sanctions against the country, analysts say.
But as Ms. Suu Kyi campaigns around the country for herself and other NLD candidates — drawing tens of thousands of people to her rallies in recent weeks– some political observers are starting to question whether she’ll accept a senior role. Ms. Suu Kyi herself has sent mixed messages on the subject.
The famed dissident has been quoted in some dissident news publications suggesting she might be interested in a cabinet post, depending on the circumstances. But speaking to students at Ottawa’s Carleton University via a video link late last month, she said it would be “rather presumptuous” to speculate on a cabinet position right now, according to reports of her comments published by Reuters news agency.
“I can tell you one thing – that under the present constitution, if you become a member of the government you have to vacate your seat in the national assembly. And I am not working so hard to get into parliament simply to vacate my seat,” she added.
Reached by phone late Monday, NLD spokesman Nyan Win said he had asked the Nobel laureate whether she would agree to a senior post, and was told “no offer, no answer,” which he says is now the party’s official position. He also repeated her concerns about how she might be forced to yield her parliamentary seat, and possibly her role as the head of the NLD, if she agrees to take on a cabinet role.
Efforts to reach the Myanmar government for comment were unsuccessful.
Everything could change, of course, if Ms. Suu Kyi is wooed by Mr. Thein Sein or promised wide-ranging policy powers.
But some analysts are starting to conclude it would be a strategic mistake for Ms. Suu Kyi to take a cabinet or advisory post unless major changes in the country’s constitution are pushed through to let her stay in parliament as well. Taking on a more senior post could open Ms. Suu Kyi to criticism from dissidents that she’s growing too close to the country’s military-backed government, which despite the reforms of the past year is still accused of human rights violations.
It could also deprive her of the ability to forge her own base of political support in Myanmar’s parliament ahead of much larger national elections expected in 2015. The April vote is being held to fill just 48 legislative seats that were vacated earlier by lawmakers promoted to ministerial posts. Even if the NLD party sweeps all the seats – including the southern Yangon district where Ms. Suu Kyi is running – it wouldn’t greatly affect the composition of parliament, which has more than 600 positions. The 2015 vote, if it is free and fair, would offer a much more realistic shot for the opposition to gain significant power in government.
Despite her age – she’s 66 – Ms. Suu Kyi is “thinking of 2015 – she’s thinking of the long game,” said David Mathieson, a Myanmar expert at Human Rights Watch in Thailand who questions whether Ms. Suu Kyi would want to be in the country’s cabinet.
For now Ms. Suu Kyi appears to be taking pains to avoid being seen as too cozy with Naypyitaw, the Myanmar capital. Ms. Suu Kyi and her party have criticized the government for several election-related problems in recent weeks, including steps by the government to make NLD leaders excise part of their party platform before reading it out on state-run radio and television because it cast the military in a bad light.
Ms. Suu Kyi also complained last week that official voter lists for the by-elections include dead people.
Myanmar officials have said they are considering the possibility of allowing outside observers to ensure the vote is free and fair, but it remains unclear whether they will do so.

Maungdaw, Arakan State: The authorities are still using force labor in northern Arakan- Maungdaw and Buthidaung – where the Rohingya people reside on March 5, said a NGOs worker who didn’t want to mention his name.
“The authorities- Burmese border security force (Nasaka) and General Engineer (GE)- are collecting Rohingya people from the villages where the authorities are repairing the road of Maungdaw-Kyein Chaung.”
“Every day 300 Rohingya people are working on the road without foods and wages. The Rohingya are carrying their foods from their home to work on the road.”
Most of the Rohingya -- day laborers – are collecting by the village administration officer as per the order of authorities to supply the laborers. A village has to supply more than 50 people to work on the road and it is depended on the population of village, said a village administration officer from Maungdaw.
“The authorities are not giving us any wages to pay the laborers who worked on the road. Most of the laborers are day workers and their families depend on their work. If they have to pay force labor, the families become starving.”
Similarly, the Light Infantry Battalions (LIBs) No. 552 is using force labor to build the battalion since last two year nearby Rohingya villagers, said a village administration officer from Buthidaung Township.
“The battalion is situated eastside of Mayu River and established on 1997.”
The army officers order the village admin to supply laborers to work at battalion. The laborers has to work – grass cutting, building road, clearing the compound of residents, carrying water from walls, working on the confiscated land and fences erecting – in the compound of battalion with their own foods. The army officers are not giving any wages to the laborers, said a school teacher from the said area.
“The laborers are Rohingya community who work on their own cultivating fields or daily laborers. Their family depended on their work. The Rohingya force laborers’ families become starving if the Rohingya people are frequently working in the army battalion.”
The Burmese new government is declaring that no force labor in the country, but the authorities are still using force labor in the ethnic areas and especially in the Rohingya area- northern Arakan- the force labor is going high up now to build road, battalion and authorities compound, said a politician from Maungdaw.

BEIJING (AP) Chinese officials have urged Burmas government to restart a Chinese-backed multibillion-dollar power dam project that was suspended apparently without notice last year.
China was caught off guard by Septembers suspension of the $3.6 billion China-funded Myitsone dam, which was being built by a Chinese company in Burma. The project had drawn protests from ethnic and environmental groups, and the suspension marked a significant about-face in Burmas domestic politics.
The officials, speaking on the sidelines of Chinas annual legislative session, said the dam would produce badly needed electricity for Burma and raise living standards, the official China Daily reported Sunday.
It quoted a former head of the National Energy Administration, Zhang Guobao, as saying the dam is a good project that will bring local residents a better life.
It also quoted Lu Qizhou, president of China Power Investment Co., which is providing the financing for the project, as saying the company will do all it can to avoid negative environmental impacts from its projects.
Burma is our friendly neighbor we hope to restart the project as quickly as possible, Lu said.
Both Lu and Zhang are members of the Chinese Peoples Consultative Committee, an advisory body to the annual National Peoples Congress being held in Beijing.
China and resource-rich Burma have historic ties, but the suspension of the dam project came as an apparent surprise to Beijing, which has long provided key diplomatic and economic support for Burma.
Burma President Thein Sein announced the suspension of the project on Sept. 30, drawing sharp criticism from the Chinese company behind the project but praise from activists who say it would displace many villagers and upset the ecology of the Irrawaddy River. It also would submerge a culturally important site in the ethnic Kachin heartland.
The dam has also been criticized because about 90 percent of the electricity it would generate would be exported to China, while the vast majority of Burmas citizens have no power.
Beijing has poured billions of dollars of investment into Burma to operate mines, extract timber and build oil and gas pipelines. China has also been a staunch supporter of the countrys politically isolated government.
China Power Investment Corp., which has threatened legal action over the move, is a state-owned company, and its website says it operates under the leadership of the State Council, which is Chinas Cabinet.

Countries that wish to see Democracy and a Free Market in Burma should not lift Sanctions too soon.
Since nominally civilian President Thein Sein suspended the Myitsone Dam to much acclaim, and U.S. Secretary of State Hillary Clintons visit to Burma late last year, the media spin by both Burmese language and Western publications that there is change in Burma has been relentless. Reporters love to preface their interviews by feeding the interviewee Now that there is change/reform in Burma
In fact, there has been no meaningful structural or institutional reform. Naypyidaw, the new capital carved out of the jungle and paddy fields in 2005, and the parliament remain largely an expensive movie set where audiences are given to foreign dignitaries who come to court. Myitsone is only one of ten dams in Northern Burma.
Aung San Suu Kyi herself said a few days ago, in Mandalay, We are trying to get on the road to democracy. Were not on the road yet. At the very start of the process, she said, There is the potential for change, but it has not changed yet.
Since I and a few other voices are the only ones remaining skeptical, we think with reason, and our voices are all but drowned out by the sounds of the big media wheel rolling downhill relentlessly, it behooves me to provide a summary and an update here.
Only now is the euphoria clearing up a little.
U.S. Special Envoy to Burma Derek Mitchell, is going to Burma March 11-18. In announcing the trip, State Department Spokesperson Victoria Nuland said about what has been done in Burma, so far so good. But she stressed the need for closer watching.
When Suu Kyi announced she would participate in the April 1 by-elections, Aung Din of U.S. Campaign for Burma warned that once she becomes part of the system designed by the junta, as a Member of Parliament, she will be able to do nothing. Recently she responded to rumors that shed be given the posts of minister of health and education, she said, according to the rules (i.e. rules set by the junta), if she becomes a minister, she would have to resign as MP. She said she hasnt been working so hard to become an MP and have a say, just to resign.
Thats just the point. The whole game has been elaborately rigged by the junta and players participate at their own considerable risk. I am never able to blame Daw Suu, as at that time she had few options left. My view is like that of long time NLD strategist, U Win Tin, who said, Even if we dont agree, we must support her. We cant appear to be divided. One commentator said, Once she gives away sanctions, she will have played her only remaining trump card and have no cards left.

In an interview with VOA (Burmese) which I have translated (see Asian Correspondent) Daw Suus first cousin whose father was assassinated in 1947 with Aung San on the same 19th July morning, now P.M. of the NCGUB or Exile Government, pointed out that even if she wins all 48 seats allotted to her of a total of 250 or so, she will still be the minority.
The area she has been assigned, and you can be sure a lot of gerrymandering went into it, is tiny Kawhmu, an agricultural village near Rangoon. I expect she was given this as the junta must have thought that her support would be highest in the educated, big urban areas.
However, Suu Kyi with the savvy of someone to the manor born, has been campaigning all over the country.
When she was first released on Nov 13, 2011, she made her first visit outside Rangoon on pilgrimage to Bagan (previously spelled Pagan) with her half-breed son (to paraphrase J.K. Rowling). Kim Aris showed his NLD colors tattooed on his arm right at Rangoon airport on first reuniting with his mother, and turned out to be as well loved and as charismatic.
Eleventh century Bagan is where it all started where Yone Hlut Kyun or a small village called Place of the Hares Release (see Bob Hudsons research on this) became the first Burmese empire of King Anawrahta, the first of the three great conquerors which are the juntas role models, as iconized by the three great king statues in Naypyidaws parade ground.
This time Aung San Suu Kyis campaign trips are as well orchestrated also as Obamas campaign in 2008. She went slowly north right up to Kachin land in Myitkyina, where she had dinner with a veteran Kachin activist who had been her fathers (very young) contemporary in 1947, and remembered the promises of the Panlong Agreement. She dressed in appropriate ethnic clothes in ethnic areas. Then she ended this round with the biggest crowds in the junta-bureaucrat stronghold of Naypyidaw, where she courted civil servants. Civil servants are people just like you and me. . .

But the campaign trail has not been as smooth as it seems in the colorful videos taken by VOA and RFA correspondents.
Stadiums have been denied to her, so that she has been forced to give speeches in the blazing heat, and had to cut her first speech short because of the up to 104 degree Fahrenheit heat.
Today the temperature in Mandalay will be 93 degrees and will be 97 on the weekend.
In Mandalay she was sick, it could be from (heat) exhaustion, but said she was better the next day. Due to the good wishes and love of the people, I am quite well again.
Her campaign continues to be assigned to large open spaces far away from town and city centers. In Mandalay, there were large tree stumps and thorn bushes, which had to be cleared by bulldozers overnight.
Her supporters always manage to pull it off.
Japanese TV NHK reports that her entourage was shot at with sharpened bicycle spokes called jinglees, a word we first heard in 1988. Also stones, according to Democratic Voice of Burma.
She complained to visiting Canadian Foreign Minister, John Baird, that electoral rolls are inaccurate, and include names of dead people. The NLDs complaints of signboards vandalized and other harassment, has been largely ignored.
I cant say if this is due to a power struggle between Thein Sein and the so-called moderates on one hand, and the hardliners, including retired Sr. General Than Shwe. Thein Sein has denied theres an internal junta split, but he also said that the West should do their part now that his administration has made all these changes. Last year even after the process started, he said there are no political prisoners.
U.S. Envoy Derek Mitchell will be accompanied by Special Representative for International Labor Affairs Barbara Shailor, who will meet with local labor representatives and will look into government-labor relations. She needs to visit factories and other work sites.
Labor strikes continue, labor laws are weak, child labor prevalent (see video documentary, They call it Myanmar.) and the work conditions of most people dismal, with no legal channels for recourse.
There are tens of thousands of landless, former farmers forced to migrate to neighboring countries, especially Thailand.
Deputy Assistant Secretary for Democracy, Human Rights and Labor Dan Bear will also accompany Mitchell, and will meet with former political prisoners. Remember, there are still an estimated 1000 political prisoners still in jail.
I want to end with a quote from a commentator who calls himself Kyansittha in the Irrawaddy Magazine, March 9.
He derisively calls the 2008 constitution, The Nargis Constitution, as the referendum was pushed through a few days after the deadly cyclone which killed an estimated 200,000 to 2.4 million (initial UN estimate).
USDP (Union Solidarity Development Party, the juntas proxy party) still holds 350 seats, including 25% unelected (i.e. assigned) military personnel snoring in the whore house (parliament) . . . Dictators never give up power voluntarily. Lifting sanctions after April Fools day elections would be akin to handling (sic) the IMF/WB/IDA all combined to Ali Than Shwe led thieves at Naypyidaw.
General Electric is rumored to be entering Burma. It is quite likely. News reports say the current crunch on hotel rooms is not being caused by tourists but by NGOs and businesses, anxious to get a foot hold inside Burma.

After decades of military repression, a nominally civilian government that was elected last year has been enacting reforms, including releasing hundreds of political prisoners, relaxing media censorship and allowing Suu Kyi to stand as a candidate for her National League for Democracy party.
However, the military is guaranteed a quarter of the seats in the country's lower house and the remainder is dominated by the main pro-military party. Under an election law brought in by the previous regime, political parties are banned from making campaign statements harmful to the military.
NLD spokesman Nyan Win said Suu Kyi's party broadcast to be taped Monday in the capital, Naypyitaw, had been approved, but a paragraph was excised under regulations that include a ban on statements harming the military's image. Her statement will be broadcast on March 14 and 22.
"The part about the lack of rule of law and about the laws enacted by successive military governments to suppress the people were censored," Suu Kyi told U.S.-funded Radio Free Asia on Saturday.
The 15-minute broadcast will be the first time the democracy icon and Nobel Peace laureate has been given the opportunity to use the state media to promote her party's platform.
Suu Kyi on Sunday campaigned in the Mon State capital of Mawlamyine, also called Moulmein, 180 miles (290 kilometres) southeast of Yangon, where thousands of supporters greeted her. She has been barnstorming the country ahead of April 1 byelections, in which her NLD party will be contesting all 48 parliamentary seats at stake. Suu Kyi herself will be running in a constituency south of Yangon.
She told supporters her party had been established with the goal of having a democratic system take root in the country, protecting human rights and preventing the reemergence of a military dictatorship. Myanmar was under army rule from 1962 until last year.
"Frankly speaking, these things have not yet been achieved," Suu Kyi said. "We are not fully enjoying human rights and the democratic system hasn't taken root yet. It is also still unclear whether a military dictatorship will emerge again or not."
Suu Kyi's party overwhelmingly won a 1990 general election, but the military refused to allow it to take power.
The NLD boycotted a 2010 general election, saying the rules were unfair. It agreed to rejoin electoral politics last year when the new military-backed elected president, Thein Sein, began implementing democratic reforms. Although the government changed some parts of the election law to meet NLD objections, campaign regulations are still very rigid.
The 17 political parties contesting the polls were allowed to deliver their party manifestos on state radio and television starting March 7, but have to submit the text at least seven days in advance.
According to campaign regulations, the speech must not be more than seven pages long and political parties are not allowed to make statements "detrimental to non-disintegration of the Union (of Myanmar), non-disintegration of national solidarity and perpetuation of sovereignty."
Statements harmful to the image of the state and the military, detrimental to security and tranquility and statements that incite service personnel are also not permitted.
Suu Kyi is rarely seen on state television, and many people watch TV with keen interest every July 19 when her picture is shown for a few seconds when she attends the annual Martyrs Day ceremony to lay a wreath at the tomb of her father, independence hero Gen. Aung San, on the anniversary of his death.
Her meetings with President Thein Sein last year and her meetings with government minister Aung Kyi, who acts as the regime's liaison official with her, were also briefly aired.
Censorship is not the only roadblock Suu Kyi's party claims to be facing.
Suu Kyi charged Thursday that official voter lists for the byelections include dead people, opening the possibility for fraud, and she called on the international community before determining their policy toward Myanmar to watch closely how the elections proceed and how the official election commission deals with complaints of electoral irregularities.
The United States and other Western nations imposed economic and political sanctions on Myanmar due to repression under the previous military regime, but are considering easing them if Thein Sein's reforms continue.

The 17 political parties contesting the polls were allowed to deliver their party manifestos on state radio and television starting March 7, but have to submit the text at least seven days in advance.
According to campaign regulations, the speech must not be more than seven pages long and political parties are not allowed to make statements "detrimental to non-disintegration of the Union (of Myanmar), non-disintegration of national solidarity and perpetuation of sovereignty."
Statements harmful to the image of the state and the military, detrimental to security and tranquility and statements that incite service personnel are also not permitted.
Suu Kyi is rarely seen on state television, and many people watch TV with keen interest every July 19 when her picture is shown for a few seconds when she attends the annual Martyrs Day ceremony to lay a wreath at the tomb of her father, independence hero Gen. Aung San, on the anniversary of his death.
Her meetings with President Thein Sein last year and her meetings with government minister Aung Kyi, who acts as the regime's liaison official with her, were also briefly aired.
Censorship is not the only roadblock Suu Kyi's party claims to be facing.
Suu Kyi charged Thursday that official voter lists for the by-elections include dead people, opening the possibility for fraud, and she called on the international community before determining their policy toward Myanmar to watch closely how the elections proceed and how the official election commission deals with complaints of electoral irregularities.
The United States and other Western nations imposed economic and political sanctions on Myanmar due to repression under the previous military regime, but are considering easing them if Thein Sein's reforms continue.
