Burmese opposition leader ASSK and the Burmese regime’s minister Aung Kyi met for the first time when the so called newly elected democratic regime took over power on July 25, 2011 at noon time in the government guest house. Both parties said the meeting was satisfactory and they are willing to cooperate together for the betterment of the Burmese people in future. After the meeting NLD party made a press conference and laid out three points that both parties agreed on.

1. Emergence of the rule of law.

2. Narrow the gap of mistrust.

3. Work for the betterment of the people.

Emergence of the rule of law

It all depends on the regime court. The regime needs to respect the law that has been written on their one sided 2008 constitution. We need to see how they respect their own law, which heavily favors the military's ability to maintain the upper hand in any interaction with civilians. Even though the constitution was one sided, it supposedly allows citizens to form independent organizations such as labor unions, peasant associations, student unions, and so forth. After the new government's 100 days in power, those organizations still cannot legally exist, nor are they allowed to form in Burma, even after some lawyers and activists tried to form them. 88 Generation leaders who demonstrated against the high consumer prices were put behind bars and are serving 65 year prison term for their believe in good governance. In addition, those people were not recognized as political prisoners, and instead were marked as criminals. Freedom of speech, freedom of organization, and freedom of publishing are still denied. Those issues need to be solved by the regime alone, and not NLD. The regime need to show it has higher tolerance level than the previous regime.

Narrow the gap of mistrust.

The first way for the regime to build trust is to release political prisoners unconditionally without delay. Then ease the ban on internet, publications, freedom of speech, and open the public forum to listen to the voice of various classes. Let them speak what they want it, and hear it without threat. The government officials need to go to the field and open up to the public as people’s servants, not as power hungry bullies. If some government officials break the law or are using his/her authority to commit a crime, put him/her in jail without hesitation and prove that rule of law exists. Allow the NLD party to organize as they wish if they did not break any laws. Recognize NLD as a political party and stop harassing its members throughout the country. NLD members whose properties were nationalized need reimbursement from the government. Allow Aung San Suu Kyi and NLD leaders to make tours throughout the country without harassment, allow the foreign aid to NGOs and political parties including USDA if the aid was for them. Start working together and helping, not only with the NLD party, but also with other political parties to help cyclone victims and patients who cannot afford to buy medicines. Stop attacking ethnic national areas and start a dialogue together with the help from NLD party to cease bloodshed. If the regime has the guts to do that, mistrust will change and see the government as a trust worthy partner not as an enemy.

Work for the betterment of the people.

No forced labor, no extra-judicial killings, no favoritism, cronyism, or monopoly in the business sector, and most importantly, creation of an independent judicial system which has full power to investigate the president, if he did wrong, are necessary for the betterment of the people. The emergence of independent newspapers, which can publish any news if the facts are correct, should be encouraged. Publishers should also be guaranteed from prosecution for publishing the truth, even if government officials are involved in the crime. Please help and support the NGOs with their social work for people in need, and more to the point, please fund them if necessary. Building schools and hospitals instead of buying tanks and jet fighters. Use 10% to 20% percent of GNP for education and health and reduce defense spending to 20-25% percent.

New Delhi (Mizzima) – A construction company in Meiktila bulldozed a 100-year-old Muslim cemetery on Monday, knocking down walls and tombstones before residents forced the company to stop, sources said.


Apparently, plans to bulldoze the cemetery have been longstanding. In 2008 and in March and May 2011, Islamic religious leaders reportedly sent letters to the authorities, urging them not to bulldoze the cemetery, but the authorities did not reply, sources said.
 
 At around 2 a.m. on Monday, three bulldozers from the Myanmar Sane Lan So Pyay Yay Company entered the old cemetery in the Aungzayyar Quarter and began bulldozing before residents could object. 

“The area of the cemetery is about 8.5 acres. Now, about four acres have been bulldozed. The bulldozers knocked down stone walls and brick tombs,” a resident said.
 
During the uproar that followed, the district and township head arrived and the company stopped bulldozing.


  
The company said in a meeting held in the Township Administrative Office on Thursday that it had bought the land and would bulldoze the land, said a source who attended the meeting.
  
Muslims in Meiktila held an emergency meeting on Monday and prepared to file a lawsuit against the company.

Since 2001, the cemetery has not been used and Muslims have been buried in Myintawkan, six miles from Meiktila.

Secretary-General Ban Ki-moon today welcomed a meeting between Nobel Peace Prize winner Aung San Suu Kyi and a Myanmar Government minister, and urged the Government to consider release of political prisoners, according to a statement issued by a spokesperson.
“The Secretary-General welcomes the meeting today in Yangon between Daw Aung San Suu Kyi and Minister for Social Welfare U Aung Kyi,” it said. “He notes that the parties have expressed satisfaction at their positive talks and their intention to cooperate further on matters beneficial to the people of Myanmar.”



“In line with the international community’s expectations and Myanmar’s national interest, the Secretary-General hopes such efforts will continue with a view to building mutual understanding through genuine dialogue. He also calls upon the Government of Myanmar to consider early action on the release of political prisoners in that country,” it said.

Vijay Nambiar, the Secretary-General’s Special Adviser for Myanmar, visited the country earlier in the year, spoke with Government officials, met with Ms. Suu Kyi and reported to the security council that although he welcomed some recent releases of political prisoners, he “reiterated the UN’s call for the urgent release of all political prisoners,” a UN spokesperson said at the time.

While the initial sentence reductions and resulting release of some political prisoners is a small step in the right direction, it has been short of expectation and is insufficient, he said.
Last month Ms. Suu Kyi called on the United Nations International Labour Organization (ILO) to expand its activities in Myanmar and help promote social justice there.

In a video message to the International Labour Conference of the ILO in Geneva she said: “In its attempt to eliminate forced labour and the recruitment of child soldiers, the ILO has inevitably been drawn into work related to rule of law, prisoners of conscience and freedom of association.”
Ms. Suu Kyi, an opposition leader put under house arrest for almost 15 years, was released on 13 November last year.

Ruler of Burma is expressible as 100 times worse than what the Kadafi of Libya. Yet, no mechanism can force the dictator to abide by domestic or intl norms and the system routed a threat to intl peace and security. UN has to truly act to bring democratic changes in Burma. At least UN must achieve to halt military regime’s brutalities. As well as failure occurred in taking action. It shows the UN’s system is not acted according its roles.

However, the world has well escalated its counter terrorisms against civilians from year;
In 1962, Ne Win over throw the U Nu government, dismissed parliament and arrested members of government and ethnic leaders.

  • On 7th July 1962, military broke-up students demonstration by bombing at Rangon university and killings 15 students.
  • In Dec 1974, killing 100 students in relating to UN former secretary U Thant funeral uprising.
  • In 1975, 1976, 1977, killings in student protests.
  • In 1967, killings 400 activists in the rice agitation protest for starvation in Akyab, Arakan state.
  • In 1970, adoption of new law restricted tourist, journalist and travelling of its citizen.
  • In 8888, crack-down on pro-democracy movement and killings 3000 people.
  • In 1990 election period, detention of 2000 people nation wide including ethnic leaders and elected member of parliaments.
  • Detention of NLD members and the other human right activists, some in 1994, about hundred in 1996, about 300 students by cracked down the student demonstration in 1996, again about 100 of NLD members in 1998.
  • On 30 May 2003-Depayin massacre, attacking by truck load resulted about 70 people killed and arrested more than hundred people.
  • In 2004, detained some activists and ethnic leaders including NDPHR’s MP.
  • On Sept 2007-Saffron Revolution, at least 31 people shot dead involving foreign reporters and arrests of about 200 monks in all over the country and activists.

In Chan, Karen, Mon and Chin states, thousands of civilians had been killed for waging wars and hundreds of villages destroyed by firing, rape-war against women, forms of brutality persecutions, extra judicial execution by branding the state terror and displacing thousands people. The attacks reached along the border and inside refugee camps of Thailand in 1995 and 1996.
  • Repression and forceful eviction operations in 1967, 1978, 1991 and continuous persecution against Rohingyas are; 1967/68 Ngazinka Operation in Kyauktaw, about hundred Rohingyas were slaughtered, women were raped, properties and lands confiscated, destructed villages and ancient religious buildings.
  • 1978-Nagamin Operation, displaced hundreds of thousand of Rohingyas including destruction of villages, imprisonment, arbitrary tortures and killings and looting cash, properties and lands. On Feb 6, the operation introduced firstly in the biggest Rohingya village Sakkipara of Akyab and started mass arrests and killings. On 11 Feb 1978, hundreds of Rohingyas from Akyab were loaded by ships and sank in Akyab-bay. On March, it reached at Buthidaung and Maungdaw and started rapes, killings, imprisonments. Within 3 months, about 300,000 Rohingyas took shelter in makeshift camp erected by Bangladesh government. In Kyauktaw, several ships led by department of immigration landed to load Rohingyas. Authorities and some de-factor Rakhines collaboration caused about 100 Rohingyas killed.
  • 1991-Pyitaya Operation, displaced again hundreds of thousand of Rohingyas including destruction of villages, imprisonment, arbitrary tortures and killings and seized cash, properties and lands. As a pro-operation, the biggest Rohingya village Sakkipara in Sittwe, was demolished. In the middle of 1992, 268,000 Rohingyas from Maungdaw, Buthidaung, Rathidaung and Akyab were uploaded as refugees. Along the operation, hundreds of model village settlement had been located at the lands of Rohingyas in all over Arakan state.
  • Killings and arbitrary punishment of Rohingyas who found in travelling are escalated as the following; 18 Rohingyas from Kyauktaw were arrested in Taungkup-Ann township and beaten to death in 1992. One of the victim’s was Husein and his brother Hassan now living in Norway.
  • Rohingyas from Maungdaw were arrested in Pann-Mraung of Mrauk Oo by military regime-377 and executed in 1993
  • 12 Rohingyas of Kyauktaw township and 2 Chins, were arrested by military in frontier area of Namada village and brought to Paletwa township of Chin state in 1994. After an interrogation was made by senior Military Intelligence (MI-10) of Kyauktaw, U Myo Khin, 7 persons were shot dead by Colonel Aung Kyaw Thein in Nonbu village and the rest 7 persons were also shot dead by Sub-Commander in Roukchaung village. The report provided- ‘suspects found in black area were shot to death’.
  • More than thousand Rohingyas youth in Maungdaw were arrested by military and shot death in 1994/95.
  • In 1994/95, 11 Muslims of Kyauk-ni-maw were captured in Taungup and sank into the river after tied up and packed by gunny.
  • In the end of 1997, a group of Rohingyas 7 people from Akyab were arrested in Tandwe township and sentenced 7 years imprisonment under section 5/nya. Some of them were now living in China border after released from prison.
  • In 2000 June,One of the group was 7 persons including a family with 12yo child and mother were convicted 7 to 22 years jail.
  • In 2003,15 Rohingyas of Akyab arrested in Yangon were sent back to Akyab then sentenced 7 years imprisonment. Some of them were from the above-stated the first group of 7 people sentenced in end of 1997.
  • On 19 Sept 2008, 136 Rohingyas of Akyab who prepared for travelling were captured in Rechanbyin village of Akyab and sent to prison. 5 men of them lifted to Yangon and 7 of their relatives living in Yangon were also detained. The rest who left in Akyab prison were detained about 6 months according to the state military command commander’s instruction and released by Kyat 1 to 3 lakh payment.
  • On 07 October 2009in Kyauktaw, the immigration authority detained 30 Rohingya activists for their refusing TRC (Temporary Registration Card) identity.
  • A group of about 54 Muslims from Kyauknimaw have been detained in Kyaukfru Prison since the end of 2009 after a confrontation was occurred between a man who travel to Kyaukfru and Immigration. He was beaten brutally by military for the result of failing to report on time and expired the 3 days Temporary Travelling Permit (TTP). The victim and his family have been escaped after the event but innocent traders and active headmen were arrested under the order of the state’s command commander. Finally, they all have been sentenced up to 20 years imprisonment by the court of Kyaukfru at the end of year 2010.
Unfortunately, investigation of ICJ is not able to launch for lack of various supports. It is also question for the intl court’s weakness despite we have resourceful evidences to support it.

It is regrettable for continuously allowing of the military junta’s brutalities towards civilians. It is time that UN must take action by militarily, instead of the unworkable economic sanctions. There is nothing to depend on Burma’s neighbours or its counter part countries or its societies because they can’t bring peace and security of the people.

The ASEAN Inter-Parliamentary Myanmar Caucus (AIPMC) released a press statement yesterday on Current Military Offensive and Rights Abuse by the Myanmar or Burma Army in Ethnic Areas -Monitor recent rape cases, reject Myanmar’s bid to chair ASEAN and cut financial lifelines for despots, AIPMC urges ASEAN.

The AIPMC highlighted about atrocities against civilians during Burma Army offensives against ethnic armed groups in Shan State and Kachin State. It also denounced Burmese soldiers’ sexual violence against women and girls, including gang-rape by order of high level officials.

The statement continues revealing warfare in North and Eastern Burma which has been worsening since last year’s election. Almost two-decade long ceasefire with the Shan State Army-North (SSA-N) and the Kachin Independence Army (KIA) have already been broken by the Burma Army.

According to Shan community based organizations, the statement says, 65 battles have taken place in Shan State over the last three weeks and now thousands people are displaced inside northern Shan State.

TORONTO — Canada has begun a strategic engagement with Myanmar that includes an exchange of ambassadors, but Ottawa has no plans to lift the economic sanctions imposed against the country anytime soon, Foreign Affairs Minister John Baird said Saturday.
 
Baird, speaking from Bali, Indonesia, where he attended a regional security forum this week, said the "limited engagement" was focused exclusively on human rights.

The catalog of documented war crimes in Burma is growing. Last week, Human Rights Watch (HRW) and the Karen Human Rights Group (KHRG) released a damning 70-page report documenting how ordinary Burmese convicts are brutally forced by the state to carry heavy munitions and supplies for the Burma Army, acting as human shields and enduring other ruthless abuses in the country's eastern war zones.

According to the report, "Dead Men Walking: Convict Porters on the Front Lines in Eastern Burmas," some of these "human pack mules" were convicted of only minor offenses, such as selling illegal lottery tickets. For their infractions, they are forced to perform the most arduous and dangerous tasks for the Burma Army, effectively being pushed into the furnace of the 63-year long civil war between the ethnic Karen opposition and the Burma Army.

Chiang Mai (Mizzima) – A Burmese government artillery unit fired more than 20 shells on Thursday at the Kachin Independence Organization (KIO) headquarters in Laiza, said party secretary La Nan.

U.S. Secretary of State Hillary Clinton called on Burma Friday to free political prisoners, address non-proliferation concerns and start a dialogue with opposition leader Aung San Suu Kyi.
Clinton told delegates at a regional security forum in Bali that Burma is a major challenge facing the 10-member Association of Southeast Asian Nations and would have to be addressed.

New Delhi (Mizzima) – Following a deadly attack on Rohingya refugees, a UK-based Rohingya organization on Thursday called on the Bangladesh government to impose more laws to protect the lives of Rohingya in Bangladesh.

Villagers from Fawliyapara Village in Cox’s Bazzar in Bangladesh on July 16 attacked Rohingya refugees in Kutupalong camp; one refugee was killed and more than 20 were injured.
The Burmese Rohingya Organisation UK (Brouk) urged the Bangladesh government to do more to protect Rohingya.

“The residents always bully Rohingya. They usually seize the things sold by Rohingya, and they beat Rohingya occasionally. We want the government to effectively protect them from being bullied by residents,” Tun Khin, the chairman of Brouk, told Mizzima.

According to Voice of America,  on 19th July,  Maj Gen Aung Than Tut, Director of Bureau of Special Operations #2 which oversees all Burma Army units in Shan State, was said to have given inhumane instruction to his troops in  Murng Nawng, Shan State, to kill all males and rape all females during their operation against the Shan State Army (SSA).
On 20th July, in relation to the upcoming final assault on the Shan State Army (SSA) North’s Wan Hai base in Kehsi township, Shan Herald Agency for News reported that orders have been issued to the Burmese troops that, “If they are E-ja-kway (Chinese Youzhagui, deep-fried twisted dough sticks), get rid of them,” one source quoted an officer as saying. “If they are Samoosa (Indian-samosa, fried stuffed pastry), eat them.” 
 E-ja-kway means male, and Samoosa means female, according to the source.
 
Tai Freedom website reported yesterday that on 15 July, Maj. Gen Aung Than Htut, Chief of Bureau of Special Operation 2 which oversees all regional commands in Shan State and Karenni State summoned his all commanders concerned to meet him in Murng Nawng Sub-township. In the meeting, the commanders were told “to kill all men, rape all women and burn down every village”.

WASHINGTON: The US House of Representatives voted overwhelmingly on Wednesday to renew for one year a ban on imports from Myanmar over alleged human rights abuses by its military rulers.

Lawmakers approved the bill, which has sailed through the US Congress annually since the restrictions first passed in 2003, by a voice vote.

A group of villagers from Fawliyapara, in the refugee camp area of Cox’s Bazar district of Bangladesh, armed with wood, pickaxes, Bamboo sticks, swords, knives and bambooears, attacked both registered and undocumented refugees in and around Kutupalong Refugees Camp killing at least one refugee and injuring twenty others, including women. Many refugees’ huts were destroyed.

U.S. Secretary of State Hillary Clinton says the Burma government's human rights record “continues to be deplorable,” and calls on India to encourage Burmese authorities to engage in dialogue with pro-democracy leader Aung San Suu Kyi.

Clinton, speaking Wednesday in India, also urged New Delhi to press the nominally civilian Burmese government to begin releasing political prisoners jailed over more than four decades of military rule.

The new military-backed namesake civilian government of Burma faces a no-win situation to acquire ASEAN’s backing for the 2014 chairmanship. If ASEAN acknowledged Burma as chairman of the group, it would definitely dishonor the name of the regional association. Burma, under the former military junta, missed its turn as chair of ASEAN in 2006 because of strong international objections led by Western countries.

In August 2004, activists in ASEAN countries launched an international campaign calling for Burma to be disqualified from chairing the regional bloc in 2006, saying it would affects the grouping’s credibility and reputation.
