In the wake of the Holocaust, the prevention of mass atrocities was one of the founding aims of the United Nations. Yet ever since the U.N.’s establishment, and the enshrinement into international law of the duty of the international community to intervene in cases of mass slaughter, individual member nations and the U.N. assembly as a whole have systematically resisted characterizing humanitarian crises as “genocides” in order to avoid their moral and legal duty to intervene. In other words, we take the concept of genocide extremely seriously. But we tend to take a more “nuanced” approach when genocides are actually happening in the world.\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003E\u003Cbr \/\u003E\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003EEven so, French President Emmanuel Macron has now \u003Ca href=\"https:\/\/www.timesofisrael.com\/macron-says-rohingya-crisis-in-myanmar-is-genocide\/\"\u003Espoken\u003C\/a\u003E of the Rohingya crisis in Burma – where, since August, two-thirds of the minority population have been pushed out of the country in a sustained campaign by the country’s military — as “genocide.” U.N. humanitarian \u003Ca href=\"http:\/\/www.wral.com\/un-official-says-rohingya-crisis-has-hallmarks-of-genocide-\/17305309\/\"\u003Eofficials\u003C\/a\u003E\u0026nbsp;describe the situation as bearing “the hallmarks of genocide.”\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003E\u003Cbr \/\u003E\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003EMeanwhile, Yanghee Lee, the U.N. special envoy on human rights in Burma, \u003Ca href=\"https:\/\/www.usnews.com\/news\/world\/articles\/2018-02-01\/un-official-says-rohingya-crisis-has-hallmarks-of-genocide\"\u003Ehas held back\u003C\/a\u003E from making the categorical declaration of genocide “until a credible international tribunal or court had weighed the evidence,” presumably for the usual political reasons. But given the mounting evidence, it is becoming increasingly difficult to characterize what is happening with euphemisms or legally watered-down terms such as “ethnic cleansing.”\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003E\u003Cbr \/\u003E\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003EAs if the obvious fact of large-scale displacement were not enough, evidence is now emerging of a number of previously unreported \u003Ca href=\"https:\/\/apnews.com\/ef46719c5d1d4bf98cfefcc4031a5434\/AP-confirms-5-previously-unreported-Myanmar-mass-graves?utm_campaign=SocialFlow\u0026amp;utm_source=Twitter\u0026amp;utm_medium=AP\"\u003Emass graves\u003C\/a\u003E\u0026nbsp;around Rakhine state, the area where most Rohingya resided before the current wave of persecution began.\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003E\u003Cbr \/\u003E\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003EThe details are telling. According to Associated Press reports, the bodies were deliberately and systematically disfigured to make them unrecognizable. For the attackers, massacring their enemies does not seem to have been enough; they also appear to have been intent on destroying the identity and memory of those they killed.\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003E\u003Cbr \/\u003E\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003ENeedless to say, no one in the Burmese state apparatus has heard anything about mass graves. But just to be sure that no evil shall be seen or heard, the U.N. special rapporteur on the situation of human rights in Burma has been barred from the country — like just about every humanitarian nongovernmental organization involved with the Rohingya, \u003Ca href=\"http:\/\/www.cnn.com\/2014\/03\/03\/world\/asia\/myanmar-rakhine-doctors-without-borders\/index.html\"\u003EMédecins Sans Frontières\u003C\/a\u003E being only the most notorious example.\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003E\u003Cbr \/\u003E\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003EDiplomatic “politeness” aside, it is hard to avoid the conclusion that Burma has reverted to its previous status as a rogue state. It pursues a systematic policy of genocide within its borders and completely stonewalls any attempt, however feeble, by the international community to establish the facts of the situation and impose some degree of accountability.\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003E\u003Cbr \/\u003E\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003EThat Burma would choose to pursue such a course of action is not completely surprising. But it is deeply disappointing after the hard work the country has put into re-engaging with the international community in the past 10 years. Since 2008, the former military junta has been working to implement a putative transition to democracy, which culminated with the election of Nobel Peace Prize laureate Aung San Suu Kyi as leader of the civilian government. Many Western observers, myself included, had hoped that this could lead to an improvement in the humanitarian record of the country.\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003E\u003Cbr \/\u003E\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003EYet despite the so-called transition to democracy, the old military leadership retains an extraordinary amount of power and influence in the country, including complete autonomy over matters of security, defense and foreign relations. What is more, much of the Burmese Buddhist population, including the leadership of the civilian government, has absorbed the decades of dehumanizing anti-Rohingya propaganda perpetrated by previous military regimes, and the current “crackdown” does in fact have wide popular support. Most of the country is rallying around the assault on the Rohingya.\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003E\u003Cbr \/\u003E\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003ENevertheless, the fact that democracy and genocide can go hand in hand is not even the most fundamental and disturbing aspect of this crisis. Rather more frightening is the impotence of the United Nations, the hollowness of international humanitarian law and the moral vacuity of the international community in the age of President Trump. Everyone at the United Nations and in capitals around the world knows that what is going on in Rakhine state is genocide and will one day be defined as such legally. But it is equally certain that the world’s political leaders will contrive to postpone assigning that status until the complete removal of the Rohingya from Burma is a fait accompli. At most, in a decade’s time, some lower-ranking military officials might get carted off to the Hague and scapegoated for the crimes of an entire society. And with that, we will also have washed our hands of our complicity in yet another genocide.\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003E\u003Cbr \/\u003E\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003EThis tragic episode paints a bleak picture of the years ahead of us. Human rights are a keystone of global stability and security. The world’s leaders undermine them at their own peril — and, unfortunately, at our peril, as well. But in an age of collapsing American global power under a callous and unenlightened presidential administration, realpolitik is the name of the game. The West sees nothing to be gained by standing up for the basic human rights of a Muslim population in a faraway country, and no other global power cares. But the precedent this sets for the authoritarian regimes of the world is as dangerous as it is clear. And now, it seems, we can no longer avoid the conclusion we have all been dreading. This is now a genocide, and we, in the international community, must recognize it as such.\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003E\u003Cbr \/\u003E\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003EThe first world leader to confront this reality has been France’s Emmanuel Macron one week ago: he condemned “this genocide which is unfolding, this ethnic cleansing”, before calling the UN to act in accordance to their obligations in such humanitarian disasters.\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003E\u003Cbr \/\u003E\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003EPresident Macron’s intervention shows the kind of moral courage we need our leaders to have in this world of escalating humanitarian disasters, from the still ongoing calamity in Syria, the Yemen famine, or the tragically under-reported violence across the Sahel.\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003E\u003Cbr \/\u003E\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003EStill, “genocide” is not a word that can or should be thrown around loosely. And not even the President of France can carry such a verdict on his own. But serious analyses by some of the world’s leading legal scholars and increasingly leaning towards the conclusion that the Rohingya are the victims of genocide.\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003E\u003Cbr \/\u003E\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003EAllard K. Lowenstein of the International Human Rights Clinic at Yale Law School, for example, has found strong evidence of genocide against the Rohingya in Myanmar in his legal analysis of the human rights situation in Rakhine state as long ago as Autumn 2015. That was when there were still over 1 million Rohingya still living in Rakhine state.\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003E\u003Cbr \/\u003E\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003E\u003Cb\u003ETragically prescient\u003C\/b\u003E\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003E\u003Cbr \/\u003E\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003ESubsequent analyses, for example by the International Stata Crime Initiative group at Queen Mary University of London in 2016, have had largely the same findings. And these analyses of the human rights situation then has proved tragically prescient. After last month’s dramatic exodus of Rohingya out of Myanmar, there are now probably fewer than 600,000 left in the country of their birth.\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003E\u003Cbr \/\u003E\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003EArticle II of UN’s 1948 Genocide Convention describes genocide as any of the following acts committed with intent to destroy, in whole or in part, a national, ethnical, racial or religious group, as such: Killing members of the group; Causing serious bodily or mental harm to members of the group; Deliberately inflicting on the group conditions of life calculated to bring about its physical destruction in whole or in part; Imposing measures intended to prevent births within the group; Forcibly transferring children of the group to another group.\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003E\u003Cbr \/\u003E\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003EThough the Rohingya situation meets most of the above criteria for being described as a genocide under international law for a number of years now, the label has been resisted until now because we think of genocide as one huge act of frenzied violence, like we have seen in Rwanda. But Rwanda has been the exception, rather than the norm.\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003E\u003Cbr \/\u003E\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003EThe Nazi genocide during WW2, for example, began slowly and had few distinctive flashes to indicate delineate where one degree of crime against humanity ended and where another began. All in all, that genocide developed and unfolded over a period of more than 10 years.\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003E\u003Cbr \/\u003E\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003EThe Rohingya situation has been going on for decades, but it has certainly been in genocide territory since at least the outbursts of communal violence in 2012. Those clashes, and the ones in the subsequent years have driven 200,000 - 300,000 Rohingya out of Myanmar.\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003E\u003Cbr \/\u003E\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003EBut somehow, at that rate of attrition, and against the backdrop of Myanmar’s supposed move toward democracy with the election of Aung San Suu Kyi to power in late 2015, world leaders have allowed themselves to hope that the situation could still be turned around.\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003E\u003Cbr \/\u003E\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003E\u003Cb\u003EReality of an exodus\u003C\/b\u003E\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003E\u003Cbr \/\u003E\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003ENow, the reality of an exodus of more than 609,000 people, amounting to approximately 50 percent of the total Rohingya population in Myanmar, in the space of just one month, the incontrovertible evidence of large scale burning of villages by the Myanmar military, the reports of widespread extra-judicial killings against fleeing civilians by the country’s federal security forces, have made it much more difficult to avoid the conclusion that this is nothing short of genocide.\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003E\u003Cbr \/\u003E\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003EThe tragedy is that the international community will compound the situation. Despite President Macron’s call for an adequate response, the UN Security Council will decline to respond to the situation with the seriousness it deserves. If a situation is defined by the Council as a “genocide”, then the UN becomes legally bound to intervene, with peace-keeping missions and so on.\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003E\u003Cbr \/\u003E\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003EThat is why Western countries will be reluctant to make the necessary commitments, and China, who is building one branch of its New Silk Road infrastructure right through Rakhine state to access the port of Sittwe, will outright veto any such proposal.\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003E\u003Cbr \/\u003E\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003EJust like we did in Rwanda, just like we did in the Balkans, we are once again seeing a genocide happen before our very eyes. But the situation has been evolving. And now, it seems, we can no longer avoid the conclusion we have all been dreading. This is a genocide. And we, in the international community, must recognize it as such.\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003E\u003Cbr \/\u003E\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003EArticle II of United Nation's 1948 Genocide Convention describes genocide as \"any of the following acts committed with intent to destroy, in whole or in part, a national, ethnical, racial or religious group, as such: Killing members of the group; Causing serious bodily or mental harm to members of the group; Deliberately inflicting on the group conditions of life calculated to bring about its physical destruction in whole or in part; Imposing measures intended to prevent births within the group; Forcibly transferring children of the group to another group.\"\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003E\u003Cbr \/\u003E\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003EThough the Rohingya situation has met most of the above criteria for being described as a genocide under international law for a number of years now, the label has been resisted until now because we think of genocide as one huge act of frenzied violence, like the machete insanity in Rwanda or the gas chambers of Nazi Germany.\u0026nbsp;\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003E\u003Cbr \/\u003E\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003EBut the final peak of violence is in all historical cases merely the visible tip of the iceberg. And the final outburst only occurs once it has already been rendered unavoidable by the political context.\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003E\u003Cbr \/\u003E\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003EIn Rwanda, Hutu tribal propaganda\u003Ca href=\"http:\/\/www.newtimes.co.rw\/section\/read\/73836\/\"\u003E ran for years\u003C\/a\u003E on the radio and in magazines referring to the Tutsis as cockroaches and a mortal threat to the Hutus that needed to be eliminated lest the Hutus themselves would die. Kill or be killed. The frenzied killing was not something that just occurred to the Hutus one day in April 1994. It was the logical conclusion of a campaign of dehumanization and paranoia which lasted for years.\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003E\u003Cbr \/\u003E\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003EThe same is true of the Holocaust. The Nazi genocide began slowly and had few distinctive outbursts of violence to delineate where one degree of crime against humanity ended and where another began.\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003EAll in all, that genocide developed and unfolded over a period of more than 10 years. Most of that period was not taken up with the killing of Jews, Gypsies and all the other \"sub-humans.\" Rather, it was taken up with manufacturing of the category of \"sub-humans\" by state propaganda. Only once the problem was manufactured and sold to the wider population did the \"final solution\" become viable.\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003E\u003Cbr \/\u003E\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003E\u003Cb\u003EPattern of genocide\u003C\/b\u003E\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003E\u003Cbr \/\u003E\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003EIn Myanmar, extremist Buddhist monks have been preaching that the Rohingya are reincarnated from snakes and insects. Killing them would not be a crime against humanity, they say -- it would be more like pest control.\u0026nbsp;\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003E\u003Cbr \/\u003E\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003EAnd necessary \"pest control\" too. Just like the Tutsi conspiracy to kill all the Hutus, or the Protocols of the Elders of Zion, the Rohingya are supposed to be agents of a global Islamist conspiracy to take over the world and forcibly instate a global caliphate. The duty of any good Buddhist who wants to maintain the national and religious character of Myanmar is to prevent the Islamist takeover, and thus to help remove the threat posed by the \"vermin.\"\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003E\u003Cbr \/\u003E\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003EEvery modern genocide has followed this pattern. Years of concerted dehumanization campaigns are the absolutely necessary pre-condition for the mass murder at the end. Usually these campaigns are led by a repressive government, but other political forces also come into play. Such was the case in \u003Ca href=\"https:\/\/bosniangenocideprojectshs.weebly.com\/dehumanization.html\"\u003EBosnia\u003C\/a\u003E, \u003Ca href=\"https:\/\/genocidememorialproject.wordpress.com\/student-memorial-pages\/rbpm-rwanda-bosnia-propaganda-memorial\/\"\u003EDarfur\u003C\/a\u003E and Rwanda. And so it is with Myanmar.\u0026nbsp;\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003E\u003Cbr \/\u003E\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003EThe campaign of dehumanization against the Rohingya has been going on for decades, and events certainly took an unmistakeable turn towards genocide since at least the outbursts of communal violence in 2012. Those clashes, and the ones in the subsequent years, drove 200,000 to 300,000 Rohingya out of Myanmar.\u0026nbsp;\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003E\u003Cbr \/\u003E\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003EBut somehow, at that rate of attrition, and against the backdrop of Myanmar's supposed move towards democracy with the election of\u003Ca href=\"http:\/\/cnn.com\/2017\/09\/05\/asia\/rise-and-fall-of-aung-san-suu-kyi\/index.html\"\u003E Aung San Suu Kyi\u003C\/a\u003E to power in late 2015, world leaders have allowed themselves to hope that the situation could still be turned around.\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003E\u003Cbr \/\u003E\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003ENow, the reality of an exodus of a further 600,000 people in the space of just six weeks; the incontrovertible evidence of large scale burning of villages by the Myanmar military -- \u003Ca href=\"http:\/\/www.cnn.com\/2017\/09\/12\/asia\/myanmar-bangladesh-rohingya-exodus\/index.html\"\u003Ewhich the military is calling clearance operations of terrorists\u003C\/a\u003E -- and the reports of widespread extra-judicial killings against fleeing civilians by the country's federal security forces have made it much more difficult to avoid the conclusion: this is genocide. We no longer have just the slow-burning genocidal environment which whittles down a people until their ultimate extinction.\u0026nbsp;\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003E\u003Cbr \/\u003E\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003ENow we are also confronting the loud bang at the end. More than half of an entire population has been removed from their ancestral lands in just eight weeks!\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003E\u003Cbr \/\u003E\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003EThe tragedy is that the international community will abet the situation. The UN Security Council will decline to respond to the situation with the seriousness it deserves. If a situation is defined by the Council as a \"genocide,\" then the UN becomes legally bound to intervene, with peace-keeping missions and so on. That is why Western countries will be reluctant initiate such a move, and China, who is building one branch of its New Silk Road infrastructure right through Rakhine State to access the port of Sittwe, will likely veto any such proposal.\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003E\u003Cbr \/\u003E\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003EJust like we did in Rwanda, just like we did in the Balkans, we are once again seeing a genocide happen before our very eyes. And we will do nothing about it. We will bury our heads in the sand, and when our children will ask us why we let this happen we will plead ignorance. Once the final act of killing starts, it is usually too late. For the Rohingya, the final act is in full swing.
