And now, it seems, we can no longer avoid the conclusion we have all been dreading. This is now a genocide, and we, in the international community, must recognize it as such.\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003E\u003Cbr \/\u003E\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003EThe first world leader to confront this reality has been France’s Emmanuel Macron one week ago: he condemned “this genocide which is unfolding, this ethnic cleansing”, before calling the UN to act in accordance to their obligations in such humanitarian disasters.\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003E\u003Cbr \/\u003E\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003EPresident Macron’s intervention shows the kind of moral courage we need our leaders to have in this world of escalating humanitarian disasters, from the still ongoing calamity in Syria, the Yemen famine, or the tragically under-reported violence across the Sahel.\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003E\u003Cbr \/\u003E\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003EStill, “genocide” is not a word that can or should be thrown around loosely. And not even the President of France can carry such a verdict on his own. But serious analyses by some of the world’s leading legal scholars and increasingly leaning towards the conclusion that the Rohingya are the victims of genocide.\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003E\u003Cbr \/\u003E\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003EAllard K. Lowenstein of the International Human Rights Clinic at Yale Law School, for example, has found strong evidence of genocide against the Rohingya in Myanmar in his legal analysis of the human rights situation in Rakhine state as long ago as Autumn 2015. That was when there were still over 1 million Rohingya still living in Rakhine state.\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003E\u003Cbr \/\u003E\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003E\u003Cb\u003ETragically prescient\u003C\/b\u003E\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003E\u003Cbr \/\u003E\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003ESubsequent analyses, for example by the International Stata Crime Initiative group at Queen Mary University of London in 2016, have had largely the same findings. And these analyses of the human rights situation then has proved tragically prescient. After last month’s dramatic exodus of Rohingya out of Myanmar, there are now probably fewer than 600,000 left in the country of their birth.\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003E\u003Cbr \/\u003E\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003EArticle II of UN’s 1948 Genocide Convention describes genocide as any of the following acts committed with intent to destroy, in whole or in part, a national, ethnical, racial or religious group, as such: Killing members of the group; Causing serious bodily or mental harm to members of the group; Deliberately inflicting on the group conditions of life calculated to bring about its physical destruction in whole or in part; Imposing measures intended to prevent births within the group; Forcibly transferring children of the group to another group.\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003E\u003Cbr \/\u003E\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003EThough the Rohingya situation meets most of the above criteria for being described as a genocide under international law for a number of years now, the label has been resisted until now because we think of genocide as one huge act of frenzied violence, like we have seen in Rwanda. But Rwanda has been the exception, rather than the norm.\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003E\u003Cbr \/\u003E\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003EThe Nazi genocide during WW2, for example, began slowly and had few distinctive flashes to indicate delineate where one degree of crime against humanity ended and where another began. All in all, that genocide developed and unfolded over a period of more than 10 years.\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003E\u003Cbr \/\u003E\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003EThe Rohingya situation has been going on for decades, but it has certainly been in genocide territory since at least the outbursts of communal violence in 2012. Those clashes, and the ones in the subsequent years have driven 200,000 - 300,000 Rohingya out of Myanmar.\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003E\u003Cbr \/\u003E\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003EBut somehow, at that rate of attrition, and against the backdrop of Myanmar’s supposed move toward democracy with the election of Aung San Suu Kyi to power in late 2015, world leaders have allowed themselves to hope that the situation could still be turned around.\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003E\u003Cbr \/\u003E\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003E\u003Cb\u003EReality of an exodus\u003C\/b\u003E\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003E\u003Cbr \/\u003E\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003ENow, the reality of an exodus of more than 609,000 people, amounting to approximately 50 percent of the total Rohingya population in Myanmar, in the space of just one month, the incontrovertible evidence of large scale burning of villages by the Myanmar military, the reports of widespread extra-judicial killings against fleeing civilians by the country’s federal security forces, have made it much more difficult to avoid the conclusion that this is nothing short of genocide.\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003E\u003Cbr \/\u003E\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003EThe tragedy is that the international community will compound the situation. Despite President Macron’s call for an adequate response, the UN Security Council will decline to respond to the situation with the seriousness it deserves. If a situation is defined by the Council as a “genocide”, then the UN becomes legally bound to intervene, with peace-keeping missions and so on.\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003E\u003Cbr \/\u003E\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003EThat is why Western countries will be reluctant to make the necessary commitments, and China, who is building one branch of its New Silk Road infrastructure right through Rakhine state to access the port of Sittwe, will outright veto any such proposal.\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003E\u003Cbr \/\u003E\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003EJust like we did in Rwanda, just like we did in the Balkans, we are once again seeing a genocide happen before our very eyes. She was accused by many of her own staff of having too cosy a relationship with the civilian government and the military elite, whilst the persecution of the Rohingya and other minorities dropped off her agenda.\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003E\u003Cbr \/\u003E\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003EHoping that the new dawn of democracy ushered in by Aung San Suu Kyi will soon start to bear fruit, the UN in general, and Lok-Dessallien in particular, were content to watch from the sidelines as hundreds were killed and tens of thousands ethnically cleansed from villages, and many thousands more were forced to flee to neighbouring Bangladesh and Malaysia on rickety boats – only to be met with conditions little better than those they had just fled. The UN seemed to have embraced the Obama Administration’s ‘Strategic Patience’ doctrine with regards to Myanmar. Which is diplomatic speak for ‘do-nothing’.\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003E\u003Cbr \/\u003E\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003EMany were relieved when it was recently announced that Reneta Lok-Desallien was moved on from her position with the Myanmar mission, a couple of years ahead of schedule. But whether the incoming Coordinator will recalibrate the priorities of the office to give due attention to the gross human rights abuses in the country remains to be seen.\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003E\u003Cbr \/\u003E\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003EPerhaps now that the world’s largest intergovernmental organisation has failed to live up to it’s responsibility towards the Rohingya, the task may be better addressed by the second largest. The plight of the Rohingya has already featured prominently on the agenda of the Organisation of Islamic Cooperation’s meeting of Foreign Ministers. In fact, the OIC held an Extraordinary Session earlier this year in Malaysia dedicated entirely to the situation of the Rohingya.\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003E\u003Cbr \/\u003E\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003E\u003Cb\u003ENot a good record\u003C\/b\u003E\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003E\u003Cbr \/\u003E\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003EOne concern might be that the OIC does not have a good record when it comes to conflict resolution. It is fundamentally handicapped in this regard, as it does not have the means by which to enforce its will. Resolutions are passed with little fanfare and go largely unnoticed outside the Muslim world. Often, their sole purpose is to mollify local populations.\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003E\u003Cbr \/\u003E\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003ENevertheless, in this case the OIC may prove significantly more effective. As the second largest intergovernmental organisation, with a membership of fifty-seven states spread across four continents, and with a new dynamic secretary general in the form of Dr Yousef bin Ahmad Al-Othaimeen, the organisation will have the verve to intervene on the issue that the UN is clearly lacking. And there are simple measures the OIC could pursue.\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003E\u003Cbr \/\u003E\u003C\/div\u003E\u003Cblockquote class=\"tr_bq\"\u003E\u003Cdiv style=\"text-align: justify;\"\u003EThe OIC does not have the happiest history when it comes to living up to its own founding principles. But on this occasion, they may well be able to succeed where the UN has failed. \u0026nbsp;-- Dr. Azeem Ibrahim\u003C\/div\u003E\u003C\/blockquote\u003E\u003Cdiv style=\"text-align: justify;\"\u003E\u003Cbr \/\u003E\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003EFirstly, the OIC can work with the UN and Myanmar authorities to investigate the allegations that militant Islamist groups are attempting to penetrate and hijack the Rohingya struggle. Though such allegations are anaemic at best, they offer a convenient excuse to the Myanmar authorities to pursue their policy of collective punishment while placating the international community and forcing it to turn a blind eye. Particularly now that ISIS is losing territory in the Middle East and are looking for new regions in the world where their poisonous ideology might find fertile ground.\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003E\u003Cbr \/\u003E\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003ESecondly, the persecution of the Rohingya has a sectarian dimension, as some of the key instigators promote these abuses in the name of a militant interpretation of Theravada Buddhism. The OIC, as a religious-based organisation, can reframe the conflict-resolution efforts of the international community in terms of an inter-faith dialogue amongst religious communities and their global leaders. The OIC itself claims to represent the global Muslim voice, and so it should be able to bring in leading global Muslim personalities who would already be acceptable and respected by the Buddhist leaders of the country.\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003E\u003Cbr \/\u003E\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003EFinally, the OIC can help relieve pressure on neighbouring countries that have taken in hundreds of thousands of Rohingya refugees such as Bangladesh, Malaysia, Thailand and so on. The government of Bangladesh is justified in trying to ensure that the Rohingya do not become a permanent presence in their own country, as they simply don’t have the resources to absorb the kinds of numbers that are fleeing. The OIC could therefore organise a coordinated global effort to provide countries like Bangladesh the basic essentials to ensure the Rohingya are comfortable during their short tenure before they are able to return to their homeland.\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003E\u003Cbr \/\u003E\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003EThe OIC does not have the happiest history when it comes to living up to its own founding principles. But on this occasion, they may well be able to succeed where the UN has failed. The Rohingya situation is providing it with an opportunity to redeem itself. And it can start with such simple measures which will have a real positive impact on the lives of so many people. The office she presided over has been described as \u003Ca href=\"http:\/\/www.bbc.com\/news\/world-asia-38091816\"\u003E‘glaringly disfunctional’\u003C\/a\u003E in internal UN documents, and the Coordinator’s strong emphasis on development programs and on having a good relationship with the Burmese government at the expense of human rights issues in the country has drawn sharp criticism from international observers.\u0026nbsp;\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003E\u003Cbr \/\u003E\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003EThis emphasis on ‘business’ over humanitarian concerns has been a stain on the UN’s reputation, but it is too early to say whether the incoming coordinator would address this problem, or whether the UN more widely is content to watch on as the Burmese military continues its methodical campaign of ethnic cleansing against the Rohingya Muslim minority in the north-west of the country, or as it continues to crack down on other border minority groups.\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003E\u003Cbr \/\u003E\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003EOther aspects of the UN’s involvement with the Burmese government are also quietly acquiescent to the developments in the country, despite \u003Ca href=\"http:\/\/www.bbc.com\/news\/world-asia-38091816\"\u003Estrong protests\u003C\/a\u003E from other Humanitarian agencies within the UN itself, such as officials from the UN refugee agency. An ongoing UN investigation led by Kofi Annan was supposed to mark a turning point in the UN’s approach to the Myanmar, but the investigation’s remit has been very strictly confined to just poverty reduction, and does not have any authority to comment on the humanitarian situation.\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003E\u003Cbr \/\u003E\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003EIndeed, Aung San Suu Kyi, the leader of the Burmese civilian government, has \u003Ca href=\"https:\/\/www.reuters.com\/article\/us-sweden-myanmar-idUSKBN1931LV\"\u003Easserted\u003C\/a\u003E that she would only accept recommendations from the UN in that narrow area, and that any UN probe into human rights abuses would be blocked on the grounds that it would “increase tensions” in the country.\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003E\u003Cbr \/\u003E\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003EThe UN’s approach to this situation has been too patient. The idea was that the new, democratically elected government in the country, led by Nobel Peace Prize laureate Aung San Suu Kyi needed to be given time to turn around the humanitarian situation in the country, and that the boat should not be rocked while they get their bearings after so many decades of military rule.\u0026nbsp;\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003E\u003Cbr \/\u003E\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003EThe hope was that under such a government the humanitarian situation would no doubt get better, even if it took some time for them to turn the direction of the country around.\u0026nbsp;\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003ESiding with the perpetrators\u0026nbsp;\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003E\u003Cbr \/\u003E\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003EUnfortunately, the assumption that a democratically elected government under Aung San Suu Kyi would be keenly interested in the humanitarian issues the country is facing turned out to be baseless.\u0026nbsp;\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003E\u003Cbr \/\u003E\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003ESuu Kyi has been in power for over 14 months at this point and throughout that period she has systematically sided with the perpetrators of the human rights abuses against the Rohingya whenever the question has been raised by the international community or by the international press.\u0026nbsp;\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003E\u003Cbr \/\u003E\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003EShe has \u003Ca href=\"http:\/\/www.telegraph.co.uk\/news\/2016\/05\/06\/aung-san-suu-kyis-government-rejects-term-rohingya\/\"\u003Ereiterated and defended\u003C\/a\u003E the ultra-nationalists’ absurd claims that the Rohingya are Bengali immigrants and that they do not exist as an indigenous ethnic group.\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003E\u003Cbr \/\u003E\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003EShe has casually dismissed concerns that the country’s military is pursuing a policy of ethnic cleansing against the group, despite the glaring facts that the entire Rohingya population have been rendered stateless, half of them have already been pushed abroad, and perhaps as many as a quarter of those who remain in the country are held in internally displaced people’s camps and not allowed to leave.\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003E\u003Cbr \/\u003E\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003EAnd she has obstructed even the most timid attempt by international agencies to censure the agencies of the state who are carrying out the latest crackdown on the group.\u0026nbsp;\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003E\u003Cbr \/\u003E\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003EIt should be clear by now that Suu Kyi is not on the same page as the rest of us on the humanitarian issues in her country.\u0026nbsp;\u003Ca href=\"http:\/\/www.bbc.com\/news\/world-asia-36353439\"\u003E‘Giving her space’\u003C\/a\u003E\u0026nbsp;will not enable her to take charge of the situation and push for positive change.\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003E\u003Cbr \/\u003E\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003EIt will simply allow her to give cover to the army to continue its crackdown on the Rohingya. Our patience will not be rewarded. And the price for our patience has already been and will continue to be paid with Rohingya blood.\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003E\u003Cbr \/\u003E\u003C\/div\u003E\u003Cdiv style=\"text-align: justify;\"\u003EThis is a price we can no longer afford. Neither the UN, nor the rest of us in the international community can allow things to continue down their current trajectory.
